اللجنة الدولية لحقوق الإنسان تنتقد بعض الإدعاءات لحقوق الناس في لبنان لعدم الأخذ بالمادة 22 و25

أعربت اللجنة الدولية لحقوق الإنسان في بيان لها بعد تلقيها تقرير من مفوضها في الشرق الأوسط ومبعوث خاص لها لشؤون الأمم المتحدة في جنيف السفير الدكتور هيثم ابو سعيد حول قضايا إنسانية مختلفة خصوصاً في ظل الأوضاع التي تعيشها البلاد في لبنان.

وأشار التقرير إلى موضوع النفقات الصحية التي صُرفت على المواطنين معتبرا أنه لا يمكن أعتبار  صرف الأموال على المواطن هدراً إذا كان هذا الأمر متعلقاً بالقطاع الصحي والتربوي خصوصاً أن الشرعة الدولية لحقوق الإنسان أقرت في :

1-      المادة (22)  لكلِّ شخص، بوصفه عضوًا في المجتمع، حقٌّ في الضمان الاجتماعي، ومن حقِّه أن تُوفَّر له، من خلال المجهود القومي والتعاون الدولي، وبما يتَّفق مع هيكل كلِّ دولة ومواردها، الحقوقُ الاقتصاديةُ والاجتماعيةُ والثقافيةُ التي لا غنى عنها لكرامته ولتنامي شخصيته في حرِّية.

2-     و المادة (25) الفقرة (1) أنه يحق  لكلِّ شخص في مستوى معيشة يكفي لضمان الصحة والرفاهة له ولأسرته، وخاصَّةً على صعيد المأكل والملبس والمسكن والعناية الطبية وصعيد الخدمات الاجتماعية الضرورية، وله الحقُّ في ما يأمن به الغوائل في حالات البطالة أو المرض أو العجز أو الترمُّل أو الشيخوخة أو غير ذلك من الظروف الخارجة عن إرادته والتي تفقده أسباب عيشه”.

تجعل الحق للمواطن لزوم شرط على الدولة ومسؤوليها تأمينه ولا يمكن أن يعتبر في غير هذا الإطار شرط أن تكون الأموال قد صُرفت في مكانها و وزمانها الصحيحين.

واعتبر السفير ابو سعيد أنه لا يمكن أن يتاجر في حقوق الناس أي إنسان مهما علا شأنه أو إدعى تمثيله لمجموعة تحت مسميات شعبية، كما لا يمكن أن يكون الحق للمواطن مادة للتجارة بغية تسجيل موقف سياسي فتسقط عنه الأخلاقيات الإنسانية، وبالتالي لا يمكن أن يمثلهم أو يدافع عنهم في المجالس المتعددة القانونية أو غيرها.

وختم البيان بالطلب إلى جميع الفرقاء الترفع عن هذه الأعمال التي لا يمكن إلا أن تثني المسؤول في سدة مسؤوليته عن قيامه بواجبه تجاه المواطنين، حيث تعتبر الإتهامات غير المقرونة بمعطيات دقيقة إرهاب فكري تمنع المثابرة في تقديم الواجبات للناس، ليكون عندها المسؤول أسير قرارات الغير وبالتالي تخفض مستوى الإنتاج العملي..

The International Human Rights Commission criticizes some of the allegations of people’s rights in Lebanon for not adopting articles 22 and 25

In a statement after receiving a report from its Commissioner in the Middle East and a special envoy for United Nations affairs in Geneva, the International Commission for Human Rights expressed Ambassador Dr. Haitham Abu Saeed on various humanitarian issues, especially in light of the conditions in the country in Lebanon.
The report referred to the issue of health expenditures spent on citizens, considering that the disbursement of funds to citizens cannot be considered wasted if this matter is related to the health and educational sector, especially since the International Bill of Human Rights has approved:

1- Article (22) Every person, as a member of society, has a right to social security, and he has the right to be afforded to him, through the national effort and international cooperation, and in a manner consistent with the structure of each country and its resources, economic, social and cultural rights that are essential to his dignity and development His personality is in freedom.

2- And Article (25) Paragraph (1) that every person has the right to a standard of living sufficient to ensure health and well-being for him and his family, especially in the matter of food, clothing, housing, medical care and the level of necessary social services, and he has the right to what the spirits believe in cases of unemployment or illness Or impotence, widowhood, old age or other circumstances beyond his control, which lose him the reasons for his livelihood. ”

It makes the right of a citizen unnecessary a condition for the state and its officials to secure it, and it cannot be considered in this framework, provided that the funds were spent in the correct place and time
Ambassador Abu Saeed considered that it is not possible to trade in the rights of people, any human being, no matter how important or claimed to represent a group under popular names, nor can the right of the citizen be a material for trade in order to register a political position so that human morals will fall from him, and therefore he cannot represent them or defend About them in multiple legal councils or others.
The statement concluded by asking all parties to refrain from these actions, which can only dissuade the official in his responsibility for carrying out his duty towards citizens, as the unconnected accusations are considered as accurate data of intellectual terrorism that prevents perseverance in submitting duties to people so that the official has the prisoner of the decisions of others and thus reduces the level of practical production ..
